These Terms of Service ("Terms") govern your access to and use of the websites, online stores, and services operated by The CMF Group ("CMF Group", "we", "us", "our"), including www.cmfgroup.co.za and www.truetech.co.za (each a "Site"), as well as our B2B distribution channel and any sales we make through third-party online marketplaces.
By using a Site, placing an order with us, or opening a trade account, you agree to these Terms. If you do not agree, please do not use our Sites or transact with us.
These Terms are issued in compliance with the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") of the Republic of South Africa.
1. About us
The CMF Group is a South African e-commerce and distribution group specialising in online retail, marketplace management, stock ownership, fulfilment, and brand growth.

2. Definitions
- "Customer", "you" — any person who accesses a Site, places an order, or opens a trade account with us.
- "Consumer" — a natural person who acquires goods for personal use, as defined in the CPA.
- "B2B Customer" — a juristic person (or person acting in the course of business) purchasing goods for resale, trade, or commercial use.
- "Goods" — any product offered for sale by us through any channel.
- "Marketplace" — any third-party online marketplace on which we list or sell Goods (e.g. Takealot, Makro Marketplace, Amazon, Bob Shop).
3. Channels covered
These Terms apply to the following sales channels:
- Direct e-commerce via www.cmfgroup.co.za.
- TrueTech.co.za — our direct-to-consumer retail channel.
- B2B / Trade Distribution — wholesale, corporate, and contract supply.
- Marketplace sales — orders placed through a third-party Marketplace are governed primarily by that Marketplace's terms (including their checkout, payment, returns, and dispute processes). These Terms apply only to the extent not inconsistent with the rules of the relevant Marketplace.
4. Eligibility and accounts
You must be 18 years or older, or have the consent of a parent or legal guardian, to transact with us. By placing an order you warrant that you have the legal capacity to enter into a binding agreement.
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately at sales@cmfgroup.co.za if you suspect unauthorised use.
We may suspend or close any account that we reasonably believe is being used unlawfully, fraudulently, or in breach of these Terms.
5. Product information, pricing, and availability
We take reasonable care to describe and price our Goods accurately, but minor errors may occur.
- All prices are listed in South African Rand (ZAR) and, unless stated otherwise, include VAT.
- Prices, promotions, and availability are subject to change without notice.
- Product images are for illustration. Actual colour, finish, or packaging may vary.
- Stock is not reserved until payment is received and the order is confirmed.
In accordance with Section 23 of the CPA, where a price displayed is the result of an obvious error (for example, a price that is clearly inconsistent with the market value of the Good), we reserve the right to cancel the affected order and refund any amount paid. We will notify you before cancelling.
6. Orders and acceptance
Your order is an offer to buy. A binding contract of sale is concluded only when we issue an order confirmation by email (or, for Marketplace orders, when the Marketplace confirms the order on our behalf).
We may decline or cancel an order, in whole or in part, where:
- the Goods are not available;
- payment cannot be verified or is suspected to be fraudulent;
- the price or product information was incorrect;
- the delivery address is outside our delivery zones; or
- we reasonably believe the order is in breach of these Terms.
If we cancel a confirmed order, we will refund any amount you have paid for the cancelled portion.
7. Payment
We accept the payment methods displayed at checkout, which may include credit/debit card, EFT, instant EFT, and approved buy-now-pay-later providers. All payments are processed through PCI-DSS compliant payment service providers. We do not store full card details.
For B2B trade customers, payment terms (including any credit facility) will be set out in a separate trade agreement or credit application. Late payment may attract interest at the prescribed rate under the National Credit Act, and outstanding accounts may be handed over for collection at the customer's cost.
8. Delivery
Delivery is governed by our Shipping Policy, which forms part of these Terms.
- Delivery timeframes are estimates and not guaranteed.
- Risk in the Goods passes to you on delivery.
- Ownership of the Goods passes to you once we have received payment in full.
- You must inspect Goods on delivery and report any visible damage or shortage within 48 hours.
If delivery is delayed by more than the agreed timeframe and we cannot deliver, you may cancel the order and receive a full refund in line with Section 19 of the CPA.
9. Returns, refunds, and your CPA rights
This section sets out your rights as a Consumer. B2B Customers have separate return rights set out in Section 10 below.
9.1 Cooling-off right for online purchases (ECTA Section 44)
For online purchases by a Consumer, you may cancel the transaction without reason or penalty within 7 (seven) calendar days of receiving the Goods. To exercise this right, contact us at sales@cmfgroup.co.za with your order number. You must return the Goods unused, in their original packaging, and in resaleable condition. You are responsible for the cost of returning the Goods. We will refund the purchase price within 30 days of receiving the returned Goods.
The cooling-off right does not apply to:
- Goods made to your specifications or clearly personalised;
- Goods that, by their nature, cannot be returned (e.g. sealed audio/video recordings or software that has been unsealed);
- newspapers, periodicals, magazines, and books;
- Goods that deteriorate or expire rapidly.
9.2 Defective, unsafe, or non-conforming Goods (CPA Section 56)
You have an implied warranty of quality for 6 (six) months from delivery. If, within 6 months of delivery, the Goods prove to be defective, unsafe, or of a quality not reasonably expected, you may return them at our cost and, at your election, receive a repair, replacement, or refund.
This right is in addition to any manufacturer's warranty.
The implied warranty does not apply to defects caused by misuse, accidental damage, unauthorised modification, or normal wear and tear.
9.3 How to return
Email sales@cmfgroup.co.za with your order number and reason for return. We will issue a return reference and instructions. Goods returned without prior authorisation may not be accepted.
Refunds are processed to the original payment method within 7–14 business days of inspection.
10. B2B (Trade) Terms
This Section 10 applies where you purchase Goods from us in the course of business, whether for resale, distribution, or commercial use. Where these B2B terms conflict with the general Terms, this Section 10 prevails.
- B2B Customers acknowledge that the CPA does not apply to the B2B relationship (Section 5(2)(b) CPA) and that the implied warranties and cooling-off right in Section 9 do not apply.
- Returns are at our discretion and are limited to manufacturer-warranty claims or pre-agreed return programmes set out in writing.
- Pricing, minimum order quantities, payment terms, credit limits, lead times, exclusivity, and any rebate or promotional support will be set out in a separate trade or distribution agreement.
- Title in Goods sold to a B2B Customer passes only on receipt of full payment. Risk passes on delivery.
- B2B Customers must adhere to any minimum advertised price ("MAP"), brand-protection, and channel-restriction policies notified to them by CMF Group or the relevant brand owner.
11. Marketplace orders
If you bought a Good from us through a third-party Marketplace:
- The contract of sale is between you and CMF Group, but is subject to the Marketplace's checkout, payment, delivery, and returns processes.
- Returns, refunds, and disputes must be initiated through the Marketplace's customer support flow.
- Where the Marketplace's terms grant you broader rights than these Terms, the Marketplace terms prevail.
- Where the Marketplace's terms are silent, these Terms apply.
12. Acceptable use of the Sites
You agree not to:
- use the Sites for any unlawful purpose;
- attempt to gain unauthorised access to any part of the Sites, our servers, or our customer data;
- introduce viruses, malware, or other harmful code;
- scrape, mirror, or otherwise copy content from the Sites without our written permission;
- impersonate any person or misrepresent your identity;
- use the Sites in a way that interferes with their availability or performance.
We reserve the right to investigate suspected breaches and to report unlawful conduct to the relevant authorities.
13. Intellectual property
All content on the Sites — including text, graphics, logos, product imagery, software, and the "CMF Group" and "TrueTech" names and marks — is owned by or licensed to CMF Group and is protected by South African and international intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on the Sites without our prior written consent, except for personal, non-commercial viewing.
Third-party brands referenced on the Sites (e.g. AOC, Canyon, Philips, Brother, Samsung, LG, Epson, RCT, Fine Living, Mia's Home) remain the property of their respective owners and are used only to identify the Goods we sell.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). By using the Sites or transacting with us you confirm that you have read the Privacy Policy.
15. Third-party links and content
The Sites may contain links to third-party websites, services, or content. We do not control, endorse, or accept responsibility for any third-party site. Your use of those sites is at your own risk and subject to the relevant third party's terms.
16. Disclaimers and limitation of liability
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability under Sections 53 to 61 of the CPA for unsafe, defective, or hazardous Goods, or for fraud or wilful misconduct.
Subject to the above, and to the maximum extent permitted by law:
- The Sites and Goods are provided "as is" and "as available". We do not warrant that the Sites will be uninterrupted, error-free, or secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive loss (including loss of profit, business, or data) arising from your use of the Sites or any Goods.
- Our total liability to you for any claim arising from or connected to your purchase of Goods will not exceed the amount you paid for the specific Goods giving rise to the claim.
17. Indemnity
You indemnify CMF Group, its directors, employees, and partners against any claim, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Sites, or your infringement of any third-party right.
18. Force majeure
We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including acts of God, war, civil unrest, load-shedding, strikes, pandemics, cyber-attacks, courier failures, or government action.
19. Suspension and termination
We may suspend or terminate your access to the Sites, your account, or any specific order if you breach these Terms, if your use poses a security or legal risk, or if continued service is no longer reasonably practical. Termination does not affect rights or liabilities that accrued before termination.
20. Changes to these Terms
We may update these Terms from time to time. The current version will always be available at www.cmfgroup.co.za. Material changes will be communicated via the Site or by email where appropriate. Continued use of the Sites after changes take effect constitutes acceptance.
21. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. You agree to submit to the non-exclusive jurisdiction of the Magistrate's Court having jurisdiction, notwithstanding that the amount in dispute may exceed the Court's normal jurisdiction.
22. Dispute resolution
If a dispute arises, please contact us first at sales@cmfgroup.co.za so we can try to resolve it informally. If the dispute cannot be resolved within 30 days, either party may:
- refer the dispute to the National Consumer Commission or the Consumer Goods and Services Ombud (for Consumer disputes); or
- pursue the dispute through the South African courts.
This does not affect your statutory rights under the CPA.
23. General
- Severability — if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
- No waiver — our failure to enforce a right is not a waiver of that right.
- Assignment — you may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to any successor in our business.
- Entire agreement — these Terms, together with our Privacy Policy and Shipping Policy (and any signed B2B agreement), constitute the entire agreement between you and CMF Group.
- Notices — notices to us must be sent to sales@cmfgroup.co.za. Notices to you may be sent to the email address or postal address linked to your account or order.
